  • Program Refunds: Full refunds available within 14 days of enrollment if no services have been accessed
  • Partial Completion: Pro-rated refunds may be available based on services utilized
  • Exceptional Circumstances: Refunds considered for medical emergencies or other qualifying situations
  • Digital Content: No refunds for accessed digital materials or completed sessions

5.3 Late Payments

Late payments may result in service suspension and additional fees. We reserve the right to use collection agencies for severely delinquent accounts.

6. Intellectual Property Rights

6.1 Our Content

All content, materials, and resources provided by Canada Career Transition, including but not limited to text, graphics, logos, images, videos, software, and course materials, are protected by copyright, trademark, and other intellectual property laws.

6.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use our materials solely for your personal career development purposes.

6.3 User Content

You retain ownership of content you submit to us but grant us a license to use, modify, and display such content for service delivery and improvement purposes.

7. Privacy and Data Protection

8. Service Availability and Modifications

9. Employment and Job Placement

9.1 No Guarantee of Employment

While we provide job placement assistance and maintain relationships with employers, we cannot guarantee employment outcomes. Success depends on multiple factors including market conditions, individual effort, and qualifications.

9.2 Employment Assistance

Our job placement services include resume assistance, interview preparation, and employer introductions, but final hiring decisions rest with employers.

10. Disclaimers and Limitations of Liability

10.1 Service Disclaimers

Our services are provided "as is" without warranties of any kind. We disclaim all warranties, express or implied, including but not limited to merchantability and fitness for a particular purpose.

10.2 Limitation of Liability

To the maximum extent permitted by law, Canada Career Transition shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, lost data, or business interruption.

10.3 Maximum Liability

Our total liability for any claim shall not exceed the amount you paid for the specific service giving rise to the claim.

You agree to indemnify, defend, and hold harmless Canada Career Transition, its officers, directors, employees, and agents from any claims, damages, losses, costs, or expenses arising from your use of our services or violation of these Terms.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of Ontario, Canada, without regard to conflict of law principles.

12.2 Dispute Resolution

Any disputes arising from these Terms or our services shall be resolved through:

  2. Mediation through a mutually agreed mediator
  3. Binding arbitration under Ontario Arbitration Act
  4. Court proceedings in Toronto, Ontario as a last resort

13. Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, pandemics, government actions, or technical failures.

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall continue in full force and effect.
